It is important to us to safeguard and protect your information, as well as your privacy.  This privacy notice (“Privacy Notice”) has been established in order to explain our online information practices and the choices you can make about the way your information is collected and used in connection with the HBO website (the “Site”).  This Privacy Notice also applies to all other websites or apps that post a link to this Privacy Notice (each and collectively the “Site”). The Site is provided by HBO Digital Latin America, LLC (“HBO,” “us,” or “we”).  References to “you” or “your” in this Privacy Notice include any user of the Site.
You should review the Terms of Use of the Site along with this Privacy Notice.
Your use of the Site and your confirmation that you have read and accepted this Privacy Notice as a part of the registration process shall serve as your acceptance of this Privacy Notice and your consent to the collection, storage, use, management, deletion, transfer, processing, and transmission (jointly, “Treatment”) of your information. Therefore, if you do not agree with the Treatment of your information, please do not use the Site. If you have any questions about the contents of this Privacy Notice, you should contact HBO (see Section XIII below).
HBO reserves the right, in its sole discretion, to modify or update this Privacy Notice, from time to time. Your continued use of the Site after HBO’s modification or update of this Privacy Notice shall serve as your acceptance of the same without any type of reservation. 
To the extent there is a material change in the Treatment of your personal information that increases our rights to use Personal Data (defined below) we have previously collected about you, HBO will notify you either through an email to your registered email address or via prominent posting on the Site in accordance with applicable laws.
HBO may engage in the Treatment of your information (including your Personal Data) as described further below.

You hereby recognize that HBO is a company based out of and headquartered in the USA. Please take into account that the information provided to us or obtained as a result of your use of the Site may be processed, transferred to, stored and used in the United States, and shall be subject to the laws of the United States. In addition, we may transfer the personal information we collect on the Site to other countries where we do business, which may not have the same data privacy and protection laws as the country in which you reside. When we transfer your information to other countries, we will protect that information as described here, even though a given country may not have the same privacy and data protection laws as the country in which you reside.  Data privacy and protection laws of the United States may not be equivalent to those in your country of residence. By using the Site, you consent to the Treatment of your information to and in the USA.

When you register for and use the Site, you may be requested to provide personal information about yourself, which may include your e-mail address, name, subscriber registration information, screen name, information about your interests, and other information you voluntarily provide (“Personal Data”).
We may also collect information about you as you use and interact with the Site. Some of this information may be collected from you when:

We may also collect certain other information when you access the Site, such as information about your computer or device, including the type of browser used, device identifier, IP address, preferred language, operating system, geographical location, date and time of your visit, websites you have browsed immediately before and after visiting the Site, hardware and software information, and the name of your Internet access provider.

We provide the Site in collaboration with certain other HBO Latin America Group companies affiliated with HBO, including HBO Latin America Production Services, L.C., HBO Ole Distribution, L.L.C., and Brasil Distribution, L.L.C., (collectively, the “HBO LAG Companies”). HBO and the HBO LAG Companies use the information collected through the Site (including Personal Data) to provide, analyze, administer, improve and customize the Site, and related programming services provided by the HBO LAG Companies, including those provided under the HBO, MAX and Cinemax brands (collectively, the “HBO LAG Services””), for marketing activities, and to get in touch with you about the Site and/or the HBO LAG Services, and other subjects. For example, we and the HBO LAG Companies may use the information we collect to:

Sometimes we may combine the information we receive online with external information (including information of our vendors and affiliated companies) in order to increase our capacity to market products or services, improve the Site and the HBO LAG Services and for research.

HBO may share your information, including Personal Data, with HBO LAG Companies for use in connection with the HBO LAG Services. 
HBO may also share your information, including Personal Data, with third parties including, but not limited to distributors (e.g., local market pay TV operators), agents, and contractors who perform services on behalf of us and the HBO LAG Companies such as verifying your eligibility to access the Site and the HBO LAG Services, hosting the Site or related applications, providing customer service, designing and/or operating the Site and the HBO LAG Services, analyzing the Site and the HBO LAG Services, reviewing user comments, enabling us to send you special offers, or performing other administrative services.
We may provide these third parties with access to user information, including identification of devices and Personal Data, necessary to carry out the services they are performing for you or on behalf of us or the HBO LAG Companies. We may also use third party analytics service providers to evaluate and provide us with information about use of the Site and the HBO LAG Services and viewing of content. These vendors may set and access their own Tracking Technologies (defined in Section VI) on your device and they may otherwise collect or have access to information about you contained on the device.
Your information may also be disclosed when required by law, by a court order, to exercise any rights in the scope of an administrative and/or judicial proceeding, or to any third party authorized by you.
HBO or the HBO LAG Companies may transfer your information to a successor of HBO or the HBO LAG Companies or any person or entity that acquires ownership or control of HBO, any of the HBO LAG Companies, the Site or any HBO LAG Services via any means including, but not limited to, a merger, acquisition, reorganization, corporate restructuring, or sale of assets. You may be notified of said transfer if HBO or the HBO LAG Companies are required to do so, in accordance with local laws and regulations.

The Site may contain links to websites with different privacy policies. You should consult the privacy policy or notices of any site you visit, as HBO has no control over the policies of third party sites. 

In addition to any Personal Data or other information that you choose to submit to the Site, we, the HBO LAG Companies and our third-party service providers may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the Site ("Usage Information"), which technologies may be downloaded to your device and may set or modify settings on your device. This Usage Information may include the browser that you are using, the URL that referred you to our Site, all the areas within our Site that you visit and your activities there, your device location, your device characteristics and certain device data, and the time in which you visited the Site, among other information.
We may use Usage Information for purposes related to the Site, such as to assess, enhance, or otherwise improve the Site or our activities in connection with it, for analytics, or for marketing purposes.
We may share Usage Information with the HBO LAG Companies for similar purposes in accordance with this Notice and as further described in Section III and Section IV, above.
When you visit and/or use our Site, we may also use cookies or similar technologies on your devices to collect, store, and communicate information about you or the activity on devices associated with you as you use the Site. By using the Site, you consent to our collection and use of your information from activity on devices associated with your account in accordance with this Privacy Notice. In addition, you consent to our collection of your IP address or other identifier ("Device Identifier") for your computer or other device used to access the Site. A Device Identifier is an identifier that is automatically assigned to your device used to access the Site, and which the Site identifies as your device by its Device Identifier. We may also access and use Device Identifiers that have already been associated with your device.
Additionally, you consent to our use of various new and hereafter developed technologies to collect Device Identifiers, Usage Information, and demographic information ("Tracking Technologies"). Some of the methods that may be used to collect Device Identifier, Usage Information, and demographic information include, without limitation, the following (and subsequent technology and methods hereafter developed):
Cookies. A browser cookie is a data file placed on a device when it is used to visit the Site. Cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to and activities in connection with the Site. The Site also may use locally stored objects to provide certain content, such as video on demand, video clips, or animation. Adobe's Flash player and similar applications use this technology to remember settings, preferences, and usage similar to browser cookies. Most cookies may be disabled or removed or blocked using tools and settings on commercial browsers. However, some cookies, such as Flash cookies or HTML5 cookies, may not be disabled through your browser. For information on disabling Flash cookies, go to Adobe's website at www.adobe.com. Please be aware that if you disable or remove cookies some parts of our Site may not work and your ability to limit cookies is subject to your browser settings and limitations.
Please note that HBO has not implemented a response to browser-based Do Not Track signals. Because of the current lack of consensus with respect to the Do Not Track standard from both a compliance perspective and a technical perspective, we have not yet determined how or if we would implement a response to Do Not Track signals. However, we will continue to evaluate the technology in the event a uniform standard is adopted.
Web Beacons. Web beacons are small strings of code that provide a method for delivering a graphic image on a web page for the purpose of transferring data, such as: the IP address of the computer that downloaded the page on which the web beacon appears, the URL (Uniform Resource Locator) of the page on which the web beacon appears, the time the page containing the web beacon was viewed, the type of browser that fetched the web beacon, the identification number of any cookie on the computer previously placed by that server, or whether an email has been opened. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. The Site may use web beacons for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent by the Site were actually opened or to count how many particular articles or links were actually viewed. The information that web beacons collect is used in aggregate form and does not identify the person.

You can also engage with our content and other offerings via third-party social media sites, plug-ins, and applications (collectively “Social Networks”). If you log into Social Network sites from the Site, the Social Network's privacy policy governs your use of the Social Network.
By agreeing to share or post content from the Site to a Social Network site, or by linking your Social Network account with your HBO account, you consent to HBO’s, or any third party hired for this purpose, collection and use the Social Network information that you have made available to be shared, including video viewing information. 
HBO or any third party on its behalf may collect information, including video viewing information, each time you share or post content from the Site to the Social Networks. You can control what data you share through privacy settings available on some Social Networks. For more information about how you can customize your privacy settings and how Social Networks handle your personal information, please refer to their privacy help guides, privacy policies and terms of use.

HBO takes reasonable measures and complies with applicable laws to ensure the safe Treatment of your information (including users’ Personal Data). HBO has physical, electronic, and managerial procedures designed to safeguard and help prevent unauthorized use, maintain the safety of your information, and appropriately use the information collected online; however, transfer of information and storage of data cannot be guaranteed to be secure and any message or information may be intercepted or accessed by unauthorized third parties, even if encrypted. HBO shall not be responsible in the event of unauthorized interception or access of your information.
You are responsible to keep your login and password information secure, and you may not provide them to anyone.

You may access your Personal Data, update it, request the correction of any error and/or delete it, without cost, by contacting us by e-mail at privacy@hbo-la.com.
Likewise, you are entitled to limit the use of any information or oppose the use thereof and revoke the consent granted for the Treatment of your Personal Data.
To access your Personal Data and make any corrections, limitations, oppositions or cancellations, you should first check the “Configuration” section of the Site where most of your Personal Data may be modified.  If you are unable to modify or delete any of your Personal Data using the “Configuration” settings, or have any other request related to the use of your Personal Data, please contact HBO directly at the e-mail previously indicated. We will use reasonable efforts to satisfy your request, however we also reserve the right to impose certain restrictions and requirements.
To protect your privacy and security, necessary measures may be taken to help verify your identity before allowing access to or making any corrections to your information.

Some aspects of the Site are intended for the general public including minors, but others are reserved for adults. In the event that minors want to participate as users, they must obtain prior authorization from their parents or legal guardians. The Site may include the ability to grant such authorization by opening a sub-account or sub-registration, which shall be dependent on the main user, who must be of legal age.
HBO does not knowingly collect any personal information submitted to the Site directly from individuals under the age of 13.
If you are a parent or legal guardian who has discovered that your child has registered for or accessed the Site without your consent, you can ask us to remove any unauthorized information provided by your child by contacting us. Upon valid notice from you, HBO will make reasonable efforts to investigate and remove the information. Please be sure to provide us with the username and e-mail address submitted by your child.

Time Warner, Inc. is an owner of HBO. We may share your Personal Data with Time Warner and Time Warner-affiliated companies, (“Time Warner Companies”) or their successors to market products and services that may be of interest to you, for research, analysis, and to assist in the improvement of the Site, the HBO LAG Services, or products and services of Time Warner Companies.  We may also share your Personal Data in connection with promotions conducted by us, by HBO LAG Companies, by Time Warner Companies, their successors, or jointly. In some cases, the information will be shared in the aggregate or Personal Data will be removed prior to sharing.   Below is a list of some of the current Time Warner Companies with whom we may share information we collect on our Site.

If at any time you wish to stop receiving promotional materials related to the Site and/or HBO LAG Services, we will provide an unsubscribe link at the bottom of each promotional e-mail you receive. In most cases, you can also opt out of newsletters in the Configuration page of the Site.

Please keep in mind that opting out of promotional e-mails will not prevent you from receiving transactional e-mail correspondence related to, without limitation: the Site, your profile, and your Registered Account (as defined in the Terms of Use). If you no longer wish to have any information collected by any mobile application included in the Site, you may uninstall the application by using the standard uninstall processes available on your mobile device or via the mobile application marketplace. In some instances, certain information or services can be provided to you only if Personal Data is provided. If you elect not to provide such information, you may not be able to access certain content or information.

We may work with third parties to present advertisements, and in data collection, reporting, ad delivery and response measurement, and site analytics on the Site (including specifically, websites and applications). We may also place advertisements on third party websites across the Internet and applications over time.

These third parties may use cookies, web beacons, pixels, or similar technologies to perform this activity. They may also obtain information about applications you use, websites you visit, and other information from across your devices and browsers in order to help serve advertising that may be more relevant to your interests on and off our Site and across your devices and browsers. This type of advertising is known as interest-based advertising. They may also use this information to associate various browsers and devices together for the purpose of interest-based advertising and other purposes like analytics.
